1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and MakeForms ("we," "us" or "our"), concerning your access to and use of the MakeForms website and platform.

By accessing the platform, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the site and you must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

Your Content: You retain all rights and ownership of your content, forms, and the data collected through your forms. We claim no intellectual property rights over the material you provide to the Service.

3. User Representations

By using the Site, you represent and warrant that:

You will maintain the accuracy of such information and promptly update such registration information as necessary.
You have the legal capacity and you agree to comply with these Terms of Service.

4. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include:

Phishing: You agree not to use MakeForms to collect sensitive personal information such as credit card numbers, social security numbers, or passwords in an insecure or deceptive manner.
Systematically retrieving data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
Circumventing, disabling, or otherwise interfering with security-related features of the Site.

5. Subscription and Payments

MakeForms offers both free and paid subscription plans. By selecting a paid plan, you agree to pay the fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for a Premium Service and will cover the use of that service for a monthly or annual subscription period as indicated.

Cancellation: You may cancel your subscription at any time. Your cancellation will take effect at the end of the current paid term. There are no refunds for partial months or years.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.
